Before using our service, please ensure you read and fully understand the terms and conditions outlined below. By accessing or using Scholar Works services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
1. DEFINITIONS
1.1. "You," "Customer," "Client" refers to any person using Scholar Works and its products/services.
1.2. "We," "Our," "Company," "Service," "Scholar Works" refers to Scholar Works as an academic assistance service.
1.3. "Product," "Service," "Solutions" refers to the academic assistance provided by Scholar Works experts.
1.4. "Website" refers to the Scholar Works website and all associated web pages.
1.5. "Order" refers to an electronic request from the Customer for a particular Product and/or service.
1.6. "Executor" refers to freelance professionals who prepare Products for Customers.
1.7. "Product" refers to the final result in electronic format that is delivered upon Order completion.
2. ELIGIBILITY
2.1. You must be at least eighteen (18) years of age to use our Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
2.2. If we learn that a person under the age of 18 has created an account or placed an Order, we reserve the right to terminate their account and cancel any Orders without liability.
3. NATURE OF SERVICES
3.1. Scholar Works offers research and academic assistance completed by freelance specialists. All Products are delivered on an "as is" basis, and the Customer uses the Products at their own risk.
3.2. Products are prepared according to the Customer's instructions by qualified Executors.
4. INTENDED USE AND CUSTOMER RESPONSIBILITY
4.1. All Products provided by Scholar Works are intended solely as model examples, study aids, tutoring supplements, and reference materials for the Customer's own learning and research purposes.
4.2. The Customer acknowledges that submitting any Product, in whole or in part, as their own original work may violate the academic integrity policies of their educational institution.
4.3. Scholar Works does not encourage, endorse, or facilitate academic dishonesty. The Customer assumes full and exclusive responsibility for how the Product is used after delivery.
4.4. Scholar Works bears no responsibility for the Customer's grades, academic standing, or any consequences arising from the Customer's use or misuse of the Products.
4.5. By placing an Order, the Customer confirms that they are aware of their institution's academic policies and that any decision to use the Product is made entirely at the Customer's own discretion and risk.
5. ORDER PROCESS
5.1. Placing an Order. When filling in an Order form, the Customer should provide a valid email address and a correct phone number. There may be multiple occasions during Order preparation when establishing contact with the Customer is crucial. Scholar Works shall not be responsible for Order delay or quality issues if they cannot be resolved due to incorrect contact data.
5.2. Instructions. Since Scholar Works works based on Customer instructions, these must be clear and precise. If the instructions are not clear and additional information is needed, the Customer should provide the necessary instructions as soon as possible.
5.3. Any revision request must be based on the initial requirements and description of the original Order. Changes from the initial instructions will be considered "editing," which is an additional service.
5.4. Sources. The Executor is allowed to use relevant sources available for the completion of the requested assignment unless the Customer specifies particular sources to be used or avoided. If specific sources are crucial for completion, the Customer should provide them within the required time schedule.
5.5. Academic Level. It is the Customer's responsibility to choose the correct academic level for their assignment. If an error is made, the Customer must contact Customer Support immediately.
5.6. Communication. The Customer should regularly check the Messaging System for updates from Customer Support or from the Executor, and promptly address any questions or concerns.
5.7. Order Progress. The Customer is encouraged to monitor Order progress through their personal account on the website.
6. PRICES AND PAYMENT
6.1. Scholar Works cannot begin working on the Customer's Order until payment for the entire amount of the Product(s) and/or service(s) has been received.
6.2. If additional payment is needed, the Customer must process it as soon as possible. Delay in additional payment may lead to delay in Order completion.
6.3. Prices are as specified on the Website; however, Scholar Works reserves the right to adjust prices due to increases in costs, taxes, duties, or other levies.
6.4. Prices for Products are exclusive of taxes and international fees, which shall be paid by the Customer.
6.5. All payment transactions are processed through secure third-party payment processors. Scholar Works does not store your full payment card information.
6.6. Scholar Works is not responsible for any fraudulent activity. The Customer is responsible for unauthorized transactions made through the Website, including account credential safety and payment instrument security.
6.7. Discounts. The Customer must be precise when filling in the Order form. A discount code cannot be applied after the Order has been paid. Special offers or discounts may not be used together at the same time and cannot be combined with additional services.
7. DELIVERY POLICY
7.1. Scholar Works guarantees delivery of the Product by the deadline chosen when placing the Order, except in the following circumstances: (a) the Customer fails to respond to requests for clarification or additional information in a timely manner; (b) the Customer changes the initial Order requirements after work has begun; (c) a Force Majeure event occurs as described in Section 20 of these Terms.
7.2. If Scholar Works fails to deliver the Product by the agreed deadline due to reasons attributable solely to Scholar Works, the Customer may be eligible for partial compensation or store credit at Scholar Works's reasonable discretion.
7.3. If the Product was received by the Customer and they requested Revision after the initial deadline, no refund will be issued for lateness. The deadline applies only to initial Product delivery.
7.4. In case of timely delivery, Scholar Works will not be responsible for failure of the Customer to download the Product. The Customer will still be billed for the service rendered.
8. VERIFICATION PROCESS
8.1. Protecting billing information and eliminating fraud is a priority for Scholar Works. We are obliged to protect payment card holders who purchase from us.
8.2. Scholar Works reserves the right to request verification information from the Customer. Everything provided for the Verification process is never shared with third parties and is used solely to verify identity.
8.3. When requested to verify billing information, it is the Customer's responsibility to comply immediately. If an Order cannot be completed in a timely manner due to delay in Verification, the Customer is required to set a new deadline after successful Verification.
8.4. Any unauthorized use of a stolen payment instrument is prohibited by law and will be reported to applicable law enforcement agencies.
9. TERMINATION
9.1. Scholar Works reserves the right to cancel any paid Order at its own determination in case of lack of cooperation/communication from the Customer that affects Order completion, or if there is suspicion of fraudulent activity.
9.2. In the event of cancellation by Scholar Works where the Customer is not at fault, a full refund shall be issued to the Customer.
9.3. In the event of cancellation due to Customer's fraudulent activity or failure to cooperate, Scholar Works shall have sole discretion to determine the appropriate refund amount, if any, based on the particular circumstances of each case.
10. REVISION POLICY
10.1. The Free Revision policy is a courtesy service provided to ensure Customer satisfaction with the completed Order.
10.2. To receive free revision, Scholar Works requires that the Customer provide the request within fourteen (14) days from the first completion date of the Order/Product, and within thirty (30) days for dissertations, theses, research proposals, or any other large assignments.
10.3. Scholar Works reserves the right to limit the number of revisions or decline revision requests in cases such as changes in initial Order details, unreasonable return of the assignment, or obvious abuse of the revision option.
10.4. If a revision request violates original instructions, Scholar Works has the right to decline it. If the request falls within the guidelines, Scholar Works will revise the Order to meet the initial requirements free of charge.
11. QUALITY ASSURANCE POLICY
11.1. The Customer can add a Quality Assurance Report service to the Order for an additional price. If ordered, Scholar Works will provide a copy of the quality assessment report for the delivered Product.
11.2. Scholar Works is not obliged to provide a copy of the quality assessment report for each Product Revision.
11.3. While Scholar Works strives to control the quality of work, due to the freelance nature of the work, we cannot guarantee flawless content, and the Product is sold as is.
12. SATISFACTION GUARANTEE AND REFUND POLICY
12.1. The Product ordered is aimed to be completed according to the Client's initial instructions.
12.2. Scholar Works does not guarantee that editing, proofreading, or formatting services will be entirely error-free. Materials not produced by Scholar Works will not be scanned or reviewed for possible errors.
12.3. All refund and cancellation requests should be communicated in writing using the Order Messaging System or by emailing Customer Support. It is the sole discretion of Scholar Works to approve or disapprove any request on a case-by-case basis.
12.4. A full refund may be given to the Customer at any time prior to Executor assignment. If the Customer placed the Order by mistake or as a duplicate, they should notify Customer Support immediately.
12.5. The Customer will not get a full refund after the Executor was assigned, since the Executor spent time and effort on the Order. The Executor should be compensated for work done.
12.6. In case of a refund request due to poor quality, the Customer must provide strong reasons and examples within fourteen (14) days after Order completion. Only after a detailed list of violations is provided will the request be forwarded for investigation.
12.7. If a full refund is issued or an Order becomes unpaid where service has already been delivered, Scholar Works retains full ownership of the Product and reserves the right to use, distribute, and share it with third parties.
12.8. No refund can be issued to the Customer if: (a) the Customer cancels the order that is in "Completed" status and more than fourteen (14) days have passed since completion; (b) the Customer is dissatisfied with Order quality but did not provide a detailed list of violations (the quality complaint is considered invalid without reasonable and detailed proof); (c) the Order is late because the Customer did not provide the information required or materials on time, or the Support Team could not reach the Customer via contacts provided.
12.9. The refund policy applies only after evaluation of the delivered Product. You cannot receive your money back if our services meet our pledge and quality standards. We retain records of all Product evaluations and communications for this reason.
12.10. Scholar Works may issue Store Credits instead of refunds in certain cases. Store Credits accepted by the Customer are non-refundable and will expire if unused within 365 calendar days.
13. COMMUNICATIONS AND PROMOTIONAL MATERIALS
13.1. Scholar Works reserves the right to contact Customers by email regarding new services, discounts, special offers, and other information deemed useful.
13.2. The Customer consents to receive emails and other forms of electronic communications, including push notifications, from Scholar Works or authorized third parties for service-related and promotional purposes.
13.3. Customers may unsubscribe from promotional emails at any time by following the unsubscribe instructions in the emails or by contacting Customer Support.
13.4. Service-related communications (such as order updates, account notifications, and security alerts) are not subject to unsubscribe and will continue as long as the Customer maintains an account.
14. PRIVACY AND SECURITY
14.1. Scholar Works is committed to protecting Customer privacy and security. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated herein by reference.

15. INTELLECTUAL PROPERTY
15.1. All content included on the Website, such as text, graphics, logos, button icons, images, digital downloads, data compilations, and software, is the property of Scholar Works or its content suppliers and protected by international copyright laws.
15.2. The compilation of all content on the Website is the exclusive property of Scholar Works and protected by international copyright laws.
15.3. If a full refund is issued, Scholar Works retains full ownership and intellectual property rights for the Product completed.
16. LIMITATION OF LIABILITY
16.1. To the fullest extent permitted by applicable law, in no event shall Scholar Works, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, academic standing, or other intangible losses, arising out of or in connection with the Customer's use of or inability to use the Services.
16.2. Scholar Works's total aggregate liability arising out of or relating to the Services or these Terms shall not exceed the total amount paid by the Customer to Scholar Works for the specific Order giving rise to the claim.
16.3. The limitations of liability set forth in this section shall apply regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, even if Scholar Works has been advised of the possibility of such damages.
16.4. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, Scholar Works's liability shall be limited to the maximum extent permitted by law.
17. INDEMNIFICATION
17.1. The Customer agrees to indemnify, defend, and hold harmless Scholar Works, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) the Customer's use or misuse of the Products; (b) the Customer's violation of these Terms; (c) the Customer's violation of any third-party rights, including but not limited to any academic integrity policy; or (d) any claim by a third party arising from the Customer's use of the Products.
18. DISPUTE RESOLUTION AND ARBITRATION
18.1. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.
18.2. The arbitration shall be conducted on an individual basis. The Customer and Scholar Works each waive the right to participate in a class action, collective action, or representative proceeding, whether in arbitration or in court.
18.3. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.
18.4. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
18.5. If this arbitration provision is found to be unenforceable for any reason, the dispute resolution and governing law provisions of Section 19 shall apply.
19. GOVERNING LAW AND JURISDICTION
19.1. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.
19.2. To the extent that arbitration is not applicable or is found unenforceable, any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in the State of Delaware, and the parties consent to the personal jurisdiction of such courts.
20. FORCE MAJEURE
20.1. Scholar Works shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, internet or telecommunications outages, power failures, strikes, or government actions.
20.2. In the event of a Force Majeure occurrence, Scholar Works will make reasonable efforts to notify the Customer and resume performance as soon as practicable.
21. WAIVER OF BREACH
21.1. No waiver by Scholar Works of any breach of this Agreement shall be considered a waiver of any other or subsequent breach. All remedies afforded in this Agreement shall be taken and construed as cumulative.
21.2. The failure of Scholar Works to insist on strict performance of any terms and conditions shall not be deemed a waiver of rights or remedies regarding that specific instance only.
22. AMENDMENTS
22.1. Scholar Works reserves the right to modify, amend, revise, or otherwise change any provisions of this Agreement at any time without notice.
22.2. The Customer agrees to be bound by subsequent modifications through continued use of services. It is the Customer's responsibility to review this Agreement periodically for changes.
23. ENTIRE AGREEMENT
23.1. This Agreement contains the entire stipulations between the Customer and Scholar Works. No statements, promises, or inducements made by either party that are inconsistent herein shall be valid or binding.
23.2. This Agreement may not be enlarged, modified, or altered except in writing signed by both parties. This Agreement supersedes all previous communications, representations, or agreements, either verbal or written.
24. SEVERABILITY
24.1. If any part, term, or provision of this Agreement is held by courts to be illegal or in conflict with any law, the validity of the remaining portions or provisions shall not be affected.
24.2. The rights and obligations of the Customer shall be construed and enforced as if the Agreement did not contain the particular part, term, or provision held to be invalid.
